E Systems Co understands the value of time so we try to keep the Terms of Use/Terms & Conditions easy to understand, short, and relevant.

This website belongs to the E Systems Co headquartered in Rawalpindi, Pakistan, and shall be used for informational purposes. For any materials you use and download from this website, you abide by the terms & conditions set by the E Systems Co. In case you don’t follow the terms set by the E Systems Co you’re hereby requested not to use the website or download any materials.

This website including any materials present excluding any third materials is the property of E Systems Co. You hereby agree to comply with all copyright laws worldwide in your use of this website to prevent any copying of materials.

E Systems Co has a business relationship with hundreds and thousands of customers, suppliers, government institutes, and contractors. For convenience and simplicity, we use words like joint ventures, partners, and partnership are used to notify the business relationships to have common interests. And those words are strictly not meant to indicate precise legal partners.

This website is controlled and operated from its offices within Pakistan and E Systems Co will not be responsible if any of the material on this website is not appropriate for any other territory or country. Any access to this website where its materials are prohibited, you’re advised not to access this website and download its contents in violation of any applicable export laws and regulations. If you access this website from outside Pakistan then you’re responsible for compliance with all local laws.

This term of use covers the treatment of the use of services and products of E Systems Co and/or the website owned and operated by E Systems Co.

This document is not applicable to the companies that E Systems Co has no ownership of or does not control or of persons that are not under employment and management of E Systems Co. Including any third-party service and/or product providers bound by contract and any third-party websites to which E Systems Co website links.

E Systems Co commits to providing the client its services that perform functions detailed under the agreed package and additional functionality sections of the project information.

To perform all services in a timely and professional manner.

To respond to all clients’ queries in a timely and professional manner.

To provide a quote or estimate, before taking any additional work required to complete a project that has not been agreed on and stated in the project information.
To deliver our best efforts to remedy any functional issues after the project is delivered.

A successful project is a collaborative effort. Being a client, you’re committed to the following:

Promptly reply to our request for branding whether it’s a logo, images, content (if you’re willing to have your own), and other information we require to complete your project.

Follow our instructions relating to the formats we require this information so we can work effectively to complete your project.

Promptly respond to our request for feedback and approval of the design and functionality of the project on a regular basis so we can fast track the progress.

You have to ensure us an employee or an agent from your company dealing with us is authorized to make decisions regarding the project on behalf of your company.

You have to be responsible for making E Systems Co fully aware of their project functionality requirements prior to commencing the project.

The client must ensure that all requirements are listed in the project information. E Systems Co will not be obligated to take any additional functionality requests that are not listed in the project information. If additional functionality come to hand after the project has commenced and they’re within the technical scope of E Systems Co’s ability. They will be quoted on and agreed upon before work on these aspects will commence.

All prices quoted are excluding GST. Before beginning your project, a 50% deposit of the design package price is required. This deposit is non-refundable as it covers E Systems Co for the purchase of your template, hosting, plugins & extensions, and initial consultation and design work.

The remaining 50% of the design package payment will be invoiced when the project is built. Additional functionality may be invoiced as it is completed, or in a combined invoice with the design package remainder.

All invoices are due 7 days from the invoice date unless otherwise stated.

In extreme cases of continued non-payment, we reserve the right to engage our collections agency to obtain outstanding funds and suspend the web and email hosting. In such cases, the client will pay any associated collection costs.

We handle every project in a professional manner to ensure that the client is delivered what was mentioned as per the terms and conditions of the proposal. However, if the client has gone through the dispute resolution process, refund claims will be considered as per the following schedule which clearly lists the services and our Terms of Use related to each service.

We will offer a full refund if, for some reason, the project has not been initiated. An agreement is drafted for every application programming project. In case no agreement has been devised and/or there is no mention of a Terms of Use, we will apply the following delivery policy:

E Systems Co will issue a partial refund upon the discretion of the service provider if the project does not get finalized as mentioned in the delivery policy and contract. The proportion of the project completed will be calculated by E Systems Co and the proportion that is not complete will be treated as per the pre-defined scope of the project.

E Systems Co offers a full refund if there is a delay in starting the project by either the programmer / designer / content writer / SEO expert (or any other resource / staff).

We will offer a proportionate refund if the client cancels the project at any point in time.

We offer no refund for days worked. If the client is not satisfied with the work at any point in time, they must immediately
notify our Project Manager and ask for discounts for any work not carried out. We will not accept any such negotiation at a later date.

Timely payments: A project is not considered to be void if the agreed upon / listed payments are not clear.

Timely communication from the client: E Systems Co is not bound by the Terms of Use. The client must provide timely information for successful completion of the project. E Systems Co will not accept any responsibility for the delay or failure of completing the project arising out of miscommunication or lack of communication in a timely manner.

Completeness of information provided by the client: E Systems Co is not obligated to respect its delivery and/or refund commitments
if the client fails to provide complete information/scope of the project to E Systems Co at initializing stage of the project.

E Systems Co will only compensate for the delay of delivery, unless there is a special agreement signed with a penalty clause for delay
in delivery.

E Systems Co liability is limited in as much to the value of the portion of the project (as per E Systems Co proposal) which may be incomplete at any given point of time. E Systems Co will not be held responsible for losses arising out of the services delivered / not delivered or the delay in the same. E Systems Co is only liable to refund if the client cancels the project, and as such, the cancellation has been communicated to E Systems Co in writing.
